        The only reason his muslim ban was upheld was that it was completely rewritten by the time it came to the Supreme Court…and included Venezuela…look no muslims there.

        Sure there are plenty of ‘national emergency’ declarations by previous Presidents, but they are in general since the 1976 legislation for the more recent ones inconsequential things.

        This is the first one where the President has asked for something in his budget and Congress hasnt agreed to that, but Trump has used national emergency to get around the financial ‘wall’ – and for something that is a campaign promise at best rather than a real emergency.
        It certainly wont be a replay of the Muslim ban, which apart from his approach to only apply to one group, was seen as within normal presidential powers.( in final court case he added south american country) . The President spending money without congress approval ( and after they rejected it) for a campaign promise is a major constitutional challenge
        Then its money allocated for military housing- hows that going to go down when they look at the run down facilities that will miss out – that will resonate in largely republican districts where these large bases exist.

      Trump lost.
      He could not get funding for his wall though and still has not.
      The emergency declaration will still be in the courts long after Trump is gone.

              1) George Papadopoulos, former Trump campaign foreign policy adviser, was arrested in July 2017 and pleaded guilty in October 2017 to making false statements to the FBI. He got a 14-day sentence.

              2) Paul Manafort, Trump’s former campaign chair, indicted on a total of 25 different counts by Mueller’s team, related mainly to his past work for Ukrainian politicians and his finances. .

              3) Rick Gates, former Trump campaign aide and Manafort’s longtime junior business partner, indicted on similar charges to Manafort.

              4) Michael Flynn, former national security adviser, pleaded guilty in December 2017 to making false statements to the FBI.

              5-20) 13 Russian nationals and three Russian companies were indicted on conspiracy charges related to a Russian propaganda effort designed to interfere with the 2016 campaign

              21) Richard Pinedo: pleaded guilty to an identity theft charge in connection with the Russian indictments

              22) Alex van der Zwaan: pleaded guilty to making false statements to the FBI about his contacts with Rick Gates and another unnamed person based in Ukraine

              23) Konstantin Kilimnik: longtime business associate of Manafort and Gates, charged alongside Manafort with attempting to obstruct justice by tampering with witnesses in Manafort’s pending case last year.

              24-35) 12 Russian GRU officers: officers of Russia’s military intelligence service, charged with crimes related to the hacking and leaking of leading Democrats’ emails in 2016.

              36) Michael Cohen: In August 2018, Trump’s former lawyer pleaded guilty to 8 counts — tax and bank charges, related to his finances and taxi business, and campaign finance violations — related to hush money payments to women who alleged affairs with Donald Trump, as part of a separate investigation in New York (that Mueller had handed off). But in November, he made a plea deal with Mueller too, for lying to Congress about efforts to build a Trump Tower in Moscow.

              37) Roger Stone: indicted lon 7 counts. He accused Stone of lying to the House Intelligence Committee about his efforts to get in touch with WikiLeaks during the campaign, and tampering with a witness who could have debunked his story.

              Finally, there is one other person Mueller initially investigated, but handed over to others in the Justice Department to charge: Sam Patten. Republican operative and lobbyist who pleaded guilty to not registering as a foreign agent with his work for Ukrainian political bigwigs, and agreed to cooperate with the government.

      So the cartoonists “argument” – which is naturally a Democrat talking point – is that this precedent will be used by a future Democrat President to enact all these things the Democrats have dreamed about.

      While at the same arguing that this National Emergency will be stymied in the courts as being unconstitutional.!

    The WH did not make one executive action today. In reality they made three, only one of which involved an emergency declaration.

    Low Information Questions-Not-Asked.

    First the WH announced they would be funding $601 million in wall construction from the Treasury Forfeiture Fund, relying on 31 U.S.C. § 9705. This does not require an emergency declaration.

    Second, the WH announced they would be funding $2.5 billion in wall construction under 10 U.S.C. § 284 (this is MilCon $ for combating drug trafficking). This does not require an emergency declaration.

    Finally, the WH announced they would be funding $3.6 billion under 10 U.S.C. § 2808. This money does require an emergency declaration.
    For Low Information Commentators.

    According to the WH this money will be spent sequentially so the § 9705 money will be spent first then the § 284 money then the § 2808 money.
    So depending on how fast they can begin construction, they will have to spend over $5 billion (including the $1.3 billion in fencing appropriations) before any of the emergency money is ever tapped

    The “MAGA Attack” of Jessie Smollet is now unravelling fast – if CNN is reporting he’s been caught making shit up, the game is probably up.

    “Jussie Smollett Viewed As “Active Participant” By Cops In Alleged Assault

    “The new direction of the investigation is now based on the premise that Mr. Smollett was an active participant in the incident,” a law enforcement source close to the situation told Deadline today.

    Lawyers for Smollett have been contacted by law enforcement in the last several hours with a request that the actor resubmit to questioning by detectives, I also hear. In anticipation of such requests, the Empire star has in recent days retained attorneys Victor P. Henderson and Todd Pugh. The Chicago-based lawyers specialize in criminal defense.

    Officially the Chicago PD had no update on the case from its statement of last night that “due to new evidence as a result of today’s interrogations, the individuals questioned by police in the Empire case have now been released without charging and detectives have additional investigative work to complete.”

    This comes as CNN is reporting that sources in the Chicago PD are saying that the actor who plays the openly gay Jamal Lyon on the hit Fox drama “paid two men to orchestrate the assault.”

        It’s been a big story picked up on by the usual hand wringing politicians such as Kamala Harris.
        and so soon after the debacle that was the Covington coverage, it is opening up a lot of dialogue on coverage of events in the US and how it has been more about what people want to believe than what is actually happening.
